Terms of Service

1. Acceptance of Terms

By accessing or using eSellar POS (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We reserve the right to update these terms at any time, and continued use of the Service constitutes acceptance of any changes.

2. Description of Service

eSellar POS is a cloud-based point of sale and business management platform. The Service includes inventory management, order processing, invoicing, customer management, and ZATCA-compliant e-invoicing. Features and availability may vary by subscription plan.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must notify us immediately of any unauthorized use of your account.

4. Subscription Plans & Payments

We offer multiple subscription plans with varying features and limits. By selecting a plan, you agree to pay the applicable fees as described at the time of purchase.

Paid plans include a 14-day free trial. You will not be charged until the trial ends and you choose to subscribe.

Subscriptions renew automatically at the end of each billing period. You may cancel your subscription at any time from your account settings.

All fees are non-refundable except as required by applicable law or as explicitly stated in our refund policy.

5. Acceptable Use

You agree not to use the Service for any unlawful purpose, to distribute malware, to attempt unauthorized access to our systems or other users' data, or to resell or redistribute the Service without written permission. We reserve the right to suspend or terminate accounts that violate these terms.

6. Data & ZATCA Compliance

You retain ownership of all data you input into the Service. We act as a data processor on your behalf.

eSellar POS supports ZATCA Phase 1 and Phase 2 e-invoicing compliance. However, you are solely responsible for the accuracy of your tax data, invoices, and business records submitted through the Service.

We do not provide tax, legal, or accounting advice. Consult a qualified professional for compliance questions.

7. Data Retention After Cancellation

Upon cancellation, your data will be retained for 30 days. During this period you may export your data or reactivate your subscription. After 30 days, your data will be permanently deleted in accordance with our Privacy Policy.

8. Limitation of Liability

To the maximum extent permitted by law, eSellar POS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service. Our total liability shall not exceed the fees you paid to us in the 12 months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
